<p>Hi, my name is Michelle Muhlbach and I am the owner of Tidy Tushees Diaper Service!  I started researching cloth diapers while pregnant with my daughter in 2010, as I was always looking for ways to lessen my carbon footprint.  Given that the average baby uses between 5000-7000 diapers (producing more than a tonne of waste); parents can make an enormous environmental impact simply by using cloth diapers.</p>

<p>It was only after meeting with Tidy Tushees previous owner, Kelly Paley, that I learned about all of the other possible risks associated with the plastic and chemicals in disposables.  Diaper manufacturers don’t have to release what is in their diapers, yet studies show that our babies are facing increased risks of cancer, respiratory illnesses including asthma, chemical burns and skin sensitivity and even declining fertility rates directly linked to the use of disposables.</p>
<p>Tidy Tushees makes it easy for families to use cloth diapers.  Soft, absorbent, fitted cotton diapers are delivered in a waterproof nylon bag each week. The diapers don’t appear to be any different than other diapers with the same shape and snaps to make them easy to use. Parents or caregivers simply change their baby the same way they would with disposable diapers, but instead of tossing the soiled diaper in a garbage bag (where it will take more than 500 years to break down in the local landfill), it goes into the delivery bag for pick up and laundering. That’s it, no dunking, rinsing or soaking. Just change your baby and help change the planet!</p>
<p>Cloth diapers aren’t any harder to use, will save families money, will reduce the incidents of diaper rash, will encourage children to potty train sooner and will have an enormous environmental impact.”</p>
<p>I was hooked and as luck would have it Tidy Tushees came up for sale about 10 months down the road…enter David Miles! At the outset I found myself thinking “How hard can this really be, it’s the sale of a business between moms”, however I quickly learned that there was a lot more to it than that!  David was essential in my purchase of the business and ensured that the purchase and all transactions ran smoothly and without any surprises, which allowed me to focus making my new venture a success!</p>
<p>What’s upcoming for Tidy Tushees?  In conjunction with Earth Day this year Tidy Tushees will be hosting the Great Cloth Diaper Change at the Laurel Packinghouse on April 21<sup>st</sup>! The Great Cloth Diaper Change is an international cloth diaper changing event, which will attempt to break last year’s Guinness World Record of 5,026 cloth diapers changed simultaneously.  Wish us luck!</p>

<p>The owners of the Warriors have been very active in the Kelowna and West Kelowna community, involving the team in many different community fundraisers to help charities and raise awareness for the team. While the team does develop players who may play in the NHL, the team’s focus is on developing players who focus on moving on to play collegiate hockey while also pursing post-secondary education.</p>
<p>The Warriors are a great game to watch and a great place to bring the family out for some great hockey at a reasonable price. If you’re lucky, the game may go into overtime where you will get to see a different OT format – teams go four on four for five minutes but instead of ending it with a shootout, they first play some three on three, ending in a tie if neither team scores. We&#8217;ve witnessed it first hand and it was some of the fastest and most exciting hockey we’ve ever watched, with the Warriors taking the win.</p>
<p>Congrats to Mark and Janelle Cheyne and their hardworking Warrior team on their many successes, and the positive impact they are having in the West Kelowna and Kelowna community.</p>

Kia Robertson struggled with being a picky eater as a child so she was determined to set healthy eating habits for her daughter Hannah. After reading about the importance of eating a rainbow of fruits and veggies she had the idea to create a chart that would allow Hannah to track the various colours of fruits and vegetables that she ate throughout the day.  Having the chart on the fridge proved to be an excellent visual reminder and helped everyone in the family to make good eating choices! </p>
<p>Eating a rainbow is a fun and easy way to get kids thinking about the importance of eating a variety of colourful fruits and vegetables everday. By breaking produce down into colour groups of fire-engine red, bright orange, sunshine yellow, emerald green, and rich purples you can make eating fruits and vegetables fun and easy for your kids! Even at a very young age, kids can easily grasp the concept of eating a rainbow!  Based on the success of the chart with their daughter Hannah, Kia and her husband Jamie set out to make the chart available to families throughout North America! 			<content:encoded><![CDATA[<p>Substantial amendments to the Power of Attorney Act came into effect on September 1, 2011.   In many respects, the changes are simply a codification of the rules that already exist at common law relating to an Enduring Power of Attorney.  Over 30 new provisions have been added to the Act to clarify the rights and obligations of the attorney being appointed under an Enduring Power of Attorney.  The Act now expressly states that an attorney must act honestly and in good faith, exercise the care diligence and skill of a reasonably prudent person, and act within their authority.  The Attorney’s duty to act in the adult’s best interests, taking into account the adult’s current wishes, known beliefs and values, has also been included in the amendments to the legislation.<br />
The new provisions of the Act also provide guidance to attorneys regarding how they are to act in exercising their powers.  An attorney is now statutorily required to give priority to the adult’s personal care and health care needs, and to promote the adult’s independence and involvement in decision-making.  The revised Act now requires that the attorney keep and produce financial records, including a current list of the adult’s property and liabilities with estimates of their values, invoices, bank statements and other records necessary to provide a full accounting of any receipt or disbursement of any  on behalf of the adult.<br />
New provisions have been added to restrict the type of person who may act as an attorney and restrict the attorney’s discretion in dealing with the adult’s assets on their behalf.  As an example, a paid caregiver is specifically prohibited from acting as an attorney for the adult, unless that caregiver is a family member.  Another new restriction relates to making a gift, loan or charitable gift from the adult’s assets.  An attorney may make a gift or loan, or charitable gift, from the adult’s property, only if expressly permitted by the Power of Attorney OR if the adult usually made such gifts; there would be sufficient property remaining to meet the adult’s needs; and as long as the total value of all gifts, loans and charitable gifts made by an attorney in a year are not more than 10% of the adult&#8217;s taxable income for the previous year OR $5,000.00, whichever is the lesser of the two.</p>
<p>So you’re probably asking yourself “How does this affect ME?”  Well if you have already granted or been appointed under an Enduring Power of Attorney before September 1, 2011, the Enduring Power of Attorney will remain valid as long as it complied with the provisions of the Act in force prior to September 1, 2011.<br />
If you are considering granting an Enduring Power of Attorney or acting as an attorney, it is important to know what responsibilities you will be obligated to fulfill as the attorney, as the requirements under the new Act can be quite onerous. </p>

			<content:encoded><![CDATA[<p>An up-to-date survey provides purchasers with a visual representation of their property, indicating items such as lot dimensions, house location and outbuildings on the lot, encroachments onto and out of the lot, fences, significant landscape features, easements/rights of way and setbacks.</p>
<p>While a survey informs and provides homeowners a picture of the physical property, it does not always provide a remedy should there be unknown adverse survey matters which cause a loss in the future.  Title insurance for residential properties is designed to compensate insureds for covered losses which include the land becoming unmarketable due to adverse matters that would have been disclosed by an up-to-date survey.  </p>
<p>Even if a new survey is obtained, there are benefits to obtaining the survey coverage found in a residential title insurance policy due to the ability to underwrite disclosed survey defects.   </p>
<p>Benefits of a title insurance policy vs. survey</p>
<p>1.	Most properties do not have an up-to-date survey, leading to additional costs that purchasers must incur in order to satisfy lender survey requirements.  The majority of lenders accept title insurance in lieu of an up-to-date survey, with the cost of title insurance being a fraction of the average cost of a survey, which can range from $500 to $1,200.<br />
2.	Even in cases where an existing survey does exist, there is no guaranty that it represents the state of the property at the time of the transaction.  Furthermore, subsequent purchasers have no rights against the surveyor who prepared it, in the event that it is incorrect.<br />
3.	Surveys obtained on new home transactions usually show only the building foundation and not improvements.<br />
4.	Title insurance survey related coverage is “no fault” based.  This means that if a loss occurs which is covered under the policy, compensation will be provided without the need to take legal action against the surveyor.</p>
<p>Survey coverage highlights for homeowners in a residential title insurance policy </p>
<p>	Someone else owns an interest in your title<br />
	Someone else has an easement on your land<br />
	Your land is unmarketable because of an adverse matter which would be disclosed by an up-to-date survey or it violates an existing zoning by-law<br />
	You are forced by a governmental authority, affected neighbour or party who benefits from the easement to remove or remedy your existing structure(s) other than a boundary wall or fence, because it extends on to adjoining land or on to any easement or because it violates an existing zoning by-law or ordinance.</p>
<p>All coverage relates to the improvements existing at the policy date.  A residential owner policy contains some post policy survey related coverage in that the insured  can be compensated for losses related to an adjoining owner constructing improvements (other than boundary walls or fences) which encroach onto the insured’s land after the policy date. </p>
<p>Both residential owner and lender policies provide broad protection to homeowners and lenders for a wide variety of survey related issues.  Nonetheless, there are circumstances where homeowners are best served by obtaining a survey as well as a title insurance policy. This is particularly beneficial in cases where the homeowner anticipates future construction to improve the property.</p>

			<content:encoded><![CDATA[<p>Let’s face it, at some point in your life your children are going to come looking for money.  Many parents find themselves frequently becoming their children’s willing (or unwilling) creditors.  From simple promissory notes, payable on demand, to more complex instruments such as mortgages, there are several options available as a means of evidencing and securing the debt.  Knowing that your children will not likely have much money in their early adulthood, you may find that a significant amount of time passes before you even think of attempting to collect on the debt.  Be Careful.  If you wait too long, you may find that your right to collect on the loan is statute barred, and the debt extinguished.</p>
<p>The Limitation Act creates limitation period traps that are easy to fall into and just as easy to avoid if the proper planning is undertaken.  Generally speaking, the limitation period for commencing an action on a debt is 6 years.  Once the limitation period has expired, the debt is no longer enforceable and you may be stuck with having provided your children with a very generous gift.  The important question then becomes “when does the limitation period begin to run?” </p>
<p>Generally, a debt becomes payable at the time stipulated in the contract.  For example, a promissory note may say that the debt must be repaid on a monthly basis or in one lump sum payment 2 years from the date the loan was granted.  Where a date for repayment is specified, and the promissory note states that the entire debt becomes payable if the date for repayment is missed, the limitation period will start to run on the date of the missed payment. </p>
<p>In other cases, the promissory note may say that the debt is payable “ON DEMAND”.  For ‘demand promissory notes’ the courts have adopted the view the limitation period begins on the date the note is made and the funds are advanced.  As a result, if parents lend money to their children under a demand note and do not demand payment or receive any payment within 6 years following the granting of the loan, the parents will likely be barred from collecting on the debt.</p>
